Breach of Contract Disputes

Contract Disputes and Contract Law

A contract can simply be described as a promise, or a set of promises, the law will enforce or recognize. When there is a contract dispute regarding a breach of contract, the law may allow for damages or even demand specific performance of the promise made.

When we get a case, we begin right away to build a case for the courtroom and put together the necessary persuasive elements. Because we are quick out of the starting block, it is often midway in the process that opposing counsel realizes that our trial lawyers are significantly ahead in investigation and discovery, and the other side can no longer commit the resources necessary to simply catch up. Settlements are often the result.

Our attorneys have an understanding of the organization that is needed to present a clear and persuasive case to the jury, and how to use storytelling and themes, with evidence that supports the themes. Viola. A breach of contract lawsuit has been successfully delivered. If that sounds simple, it’s because simple works for juries.

Our business trial lawyers at Ogborn, Summerlin & Ogborn are familiar with all aspects of contract law including consultant contracts, contractor agreements, insurance claim disputes, bad faith lawsuits, and other related matters. The examples below are common contract disputes that arise.

Unpaid loans

If you loaned money to another company without getting anything on paper, you engaged in what is called an unsecured transaction. That does not mean you do not have any legal recourse, it means that you need a business law firm to go in and file a mandatory injunction and freeze the other business’s assets before your money disappears. Your best chance of an optimal recovery of your funds is to move quickly

Failures in the performance of professional services

We have helped our clients deal with negligent lawyers, industrial hygienists, accountants, stockbrokers, financial planners, architects, and engineers.

Failures to supply goods

We help companies when goods are defective, not as promised, never delivered, or delivered late.

Real estate transaction disputes

We have represented builders, developers, and owners in real estate contractor disputes ranging from home purchases to golf course and resort developments.

Disputes protected under the Government Immunity Act (GIA)

Our law firm won a case in the Court of Appeals that involved a general contractor that was contracted to renovate old state buildings. The State of Colorado was the manager on two of these projects. The building conditions were different than what was agreed to in the contract, and the state refused to provide change orders for additional costs that would be necessary. Our client successfully sued the state in this case.

If your company or organization has a contract that has been unfulfilled or violated, or you are being sued in breach of contract dispute in either Colorado or Nebraska, we urge you to call or contact our law office today.
